Overe® accepts no liability arising from this Website (including associated links or our offerings) being incorrect, incomplete or misleading. To the fullest extent permitted by law, Overe® will not be liable for any loss, damage, cost or expense incurred or arising due to the information from this Website.

Where conditions and warranties implied by law cannot be excluded, Overe® limits its liability, where it is entitled to do so, to the resupply of the relevant products or services, or payment of the monetary value of the resupply.

On this website you will find our products, guides, courses, videos and other digital resources. This information is provided solely for your personal journey, education and self care.

Bookings, payments and communications

We operate our booking and payment platform (including Acuity and our connected systems) to manage availability, confirmations, reminders, reschedules and cancellations. Your booking confirmation will include key details such as appointment type, location (if applicable), time and practitioner.

If you have an issue with booking administration, payment processing, receipts, or appointment logistics generated through our platform, please contact us at connect@overe.co.

Independent Practitioners and Booking Facilitation

Overe® provides booking administration, marketing support, payment processing and referral infrastructure for a network of independent Overe® practitioners.

Unless expressly stated otherwise (for example, where a session is delivered directly by a Founder of Overe®), sessions listed on this Website and booked through the Overe® platform are delivered by independent practitioners operating their own businesses.

When you book a session with an Overe® practitioner, you are contracting directly with that practitioner for the delivery of services. Overe® facilitates the booking and payment process but does not provide therapeutic, health or wellbeing services in relation to sessions delivered by independent practitioners.

Each practitioner is solely responsible for:

  • the services they deliver,
  • their professional conduct and clinical decision-making,
  • suitability screening and client care,
  • and compliance with their own professional, insurance and regulatory obligations.

Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between Overe® and any independent practitioner.

Concerns, feedback and complaints

Some sessions, group experiences and programs booked through Overe® are delivered by independent Overe® practitioners (not always the Overe® founders). When you book, we will confirm the name of your chosen practitioner in your booking confirmation.

Your session is delivered by your practitioner using their professional judgement and approach within the Overe® ecosystem. Results vary and no particular outcome is guaranteed. If you have concerns about the quality of a session or your experience with a particular practitioner, we ask that you contact your practitioner first so they have the opportunity to understand your concern and work with you toward a resolution.

If you are not comfortable contacting your practitioner directly, or you cannot reach them, you can contact us at connect@overe.co and we will support you to route the issue appropriately. Please note we may need to share relevant information with your practitioner on a need-to-know basis to help address your concern (in line with our Privacy Policy).

Nothing in these terms is intended to exclude any rights you may have under the Australian Consumer Law.

Practitioner responsibility

Each independent practitioner is responsible for the professional services they deliver, including the manner in which sessions are conducted, advice given, and client care provided.

Overe® does not supervise or control clinical decision-making and does not assess the appropriateness of any practitioner’s professional judgment.

We require practitioners within the Overe® network to maintain appropriate professional indemnity insurance and to comply with applicable privacy, marketing and consumer laws. However, responsibility for the delivery of services rests solely with the practitioner providing your session.

To the fullest extent permitted by law, Overe® is not liable for acts, omissions or representations made by independent practitioners in the delivery of their services.

We may modify the content provided on this website at any time, including altering or deleting it without notice. Any changes are effective immediately upon posting to this website. Your continued use of the website from this point onward will include your agreement to all Terms & Conditions.

There is no professional relationship formed by your visit to our website unless you explicitly choose to work with us by purchasing our services.

Healing and transformational services delivered by Overe® founders or independent Overe® practitioners are distinct from counselling, psychotherapy or psychoanalysis and does not deal with the diagnosis or treatment of emotional problems. Since our services do not constitute medical consultation or treatment, health insurance does not apply.

It is your responsibility to acknowledge that the processes that Overe® will facilitate may bring up deep emotional release, physical tensions and potential traumas. You acknowledge that you are consenting to this process and knowing this you are responsible for your choice to engage our services. By committing to an Overe® service, you voluntarily agree to release, waive and discharge.

(For clarity: when you book services through Overe®, we use third-party systems to manage bookings and communications — including Acuity and our CRM — as described in our Privacy Policy.)

Accepting your Order

Where you purchase a product, course or program directly from Overe®, the agreement between you and Overe® is formed when we confirm your purchase or commence providing the relevant service.

Where you book a session delivered by an independent practitioner through the Overe® platform, the agreement for the delivery of that session is between you and the selected practitioner.

We reserve the right to not accept your order in the event that we are unable to obtain payment authorisation, if the services are unavailable or otherwise decided by us within these Terms and Conditions.

Payment Terms

You may pay for your order with a credit or debit card that belongs to you or that you have permission to use. If the card issuer refuses payment to us, we are not liable for any delays or non-delivery of your order. Your order will not be dispatched until full payment has been received.

Security Policy

We accept online payments such as credit card or debit cards through Stripe. The providers we use include: Stripe, Squarespace, Drip, Acuity & Typeform throughout your journey. These platforms have their own SSL certificates and encryption protection.

(We also use other platforms and service providers from time to time to support bookings, communications and delivery. Details are set out in our Privacy Policy.)

Shipping & Delivery

All digital products, online courses or guides will be sent to you via email within 24hrs of your order being completed with full payment. Other services and in-person or live delivery of training will be confirmed within 24 hours. These services will be held via Zoom, unless otherwise stated. A personal Zoom link will be emailed to you with confirmation and 24hrs prior to the ceremony commencing.

Risk

If you receive a damaged product in your order please let us know via email connect@overe.co.

Refund Policy & Guarantees

We are passionate about providing the most divine, premium products for our community that honour the flow of nature. Due to the nature of the services we supply, we cannot provide a refund for change of mind.

If you do have any questions or feedback on Overe® products or services please contact our team within 7 days, connect@overe.co so we can collaborate with you to create a mutually beneficial outcome.

We take our obligations under Australian Consumer Law seriously and will do our best to address any issues that arise. However, even if there is a major problem, our liability is strictly limited to the below:

  • Providing the services again; or
  • If we are unable to do so within a reasonable time, we will pay the cost of having the relevant service supplied to you again.

Respectful Communication

We reserve the right to delete any comments on our Website or social media accounts which are rude, offensive or which we deem to be unacceptable. We ask you to please act with integrity, kindness, respect and honour for each person who may be within our community and on our platforms.

If you have any constructive comments or feedback we ask that you please contact our team at connect@overe.co before posting to any of our platforms or review sites so that we can work together to find a suitable resolution.

Dispute Resolution & Jurisdiction

If either of us have any concerns arising out of these terms, your use of our Website or our provision of products or services, we agree that we shall communicate with the intention of making a genuine effort to seek a win/win solution and resolve any dispute by negotiation and discussion.

We ask that you please email our team connect@overe.co with your concerns as soon as possible and within 7 days of the issue occurring.

If a dispute arises, you agree that you will not engage in any public discussion about the issues, will behave politely towards us, and will avoid any conduct or communication which might reasonably be expected to interfere with our business or personal interests. You agree to act in good faith and be reasonably cooperative at all stages of the dispute resolution process. We will treat you with the same consideration.If there is a problem, you agree to meet with [me/us] in good faith to discuss it and try to make a genuine effort to find a win-win solution. If the problem cannot be resolved within a reasonable time, you agree to engage in mediation and alternative methods of dispute resolution, with litigation being a last resort and any mediation costs shared equally. We commit to making a similar effort to resolve any disputes in a friendly manner

Everyone involved in the dispute agrees that they will not publicly or privately disparage any other party or anyone associated with them, and will act in good faith to refrain from any conduct or communication which might reasonably be expected to interfere with any other party’s business or personal interests.

This agreement is subject to the governing law of New South Wales, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
